The terms for using SurveyMarkup during the pilot stage.
By accessing or using SurveyMarkup, you agree to these Terms of Use and our Privacy Policy.
SurveyMarkup is operated by Tim Albash, sole trader, ABN 50 427 523 590. The operator is based in Queensland, Australia and is not currently registered for GST.
SurveyMarkup is provided as an early-stage tool and may change. Features, outputs and availability may change.
SurveyMarkup does not replace professional judgement, survey review, cadastral compliance checking or legal boundary determination.
Users are responsible for checking source data, settings, coordinate systems, exports and final outputs.
Pilot accounts are personal to the invited user or firm. You are responsible for keeping your sign-in credentials secure, for the activity that happens under your account, and for making sure the details you give us are accurate. Tell us promptly if you believe your account has been accessed without authorisation.
Outputs are not certified survey documents and must not be treated as automatically approved.
Pilot access may be granted, limited, changed or removed manually.
The service may be interrupted or changed during pilot development.
SurveyMarkup, including its software, branding and site content, is owned by SurveyMarkup or its licensors. You keep ownership of the files and data you upload, and you grant SurveyMarkup permission to process them only to provide the features you use.
Do not misuse the service: no unlawful use, no attempts to disrupt or gain unauthorised access, and no uploading of content you do not have the right to process.
SurveyMarkup is invite-only and base pilot access is provided without charge. Access to the pilot does not depend on any payment. Some invited users may be offered a prepaid pilot membership (see below); any other paid plans, if introduced, will come with separate fee, billing and refund terms that must be accepted before any payment. No prices are published on this site — commercial terms are stated in your offer or agreed with your firm before any charge.
Some invited users may be offered a prepaid pilot membership: a fixed prepaid term of pilot access, paid once, with no automatic renewal. The price, term and refund window are stated in your offer before you pay, and the membership entitlement activates only once your payment is confirmed. Refunds are available within the refund window as stated in your offer at purchase — see our Refunds page. A prepaid pilot membership does not change what SurveyMarkup is: it includes no professional advice and no survey sign-off, all outputs remain advisory only, and a registered surveyor must confirm any result before reliance.
Signed-in pilot users may choose to make an optional one-off support payment. These payments are entirely optional and do not purchase or change access, queue priority, features, support priority, professional advice or survey certification — your pilot access is the same whether or not you contribute. They are not donations and are not represented as tax-deductible, and no GST is charged. There are no recurring payments and no perks or rewards.
If you make an optional support payment by mistake, email admin@surveymarkup.com and we will consider the request and handle it manually, subject to applicable law. This does not limit any rights you have under the Australian Consumer Law. Refund handling for all payment types is summarised on our Refunds page.
SurveyMarkup also offers a scoped advisory QA review service. Each services engagement is governed by a separate written per-engagement agreement: scope, fee and turnaround are agreed in writing before any work begins, and that agreement governs the engagement — including its payment and refund arrangements. All service findings remain advisory only and must be confirmed by your registered surveyor.
SurveyMarkup is built with open-source software and self-hosted open fonts under their own licenses, acknowledged in our third-party notices at /third-party-notices. Those components remain owned by their respective authors under their stated licenses.
SurveyMarkup references public surveying standards — including GDA2020, GDA94, MGA, AUSGeoid and AHD — for compatibility only. SurveyMarkup claims no ownership of, and no authority over, those standards, does not certify conformance to them, and outputs remain advisory and unverified. A registered surveyor must confirm any result before reliance.
To the maximum extent permitted by law, SurveyMarkup and its providers are not liable for indirect, incidental or consequential loss from use of the service.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded.
These terms are governed by the laws of Australia, and you submit to the courts of Australia for any dispute, without affecting any non-excludable rights you have in your own jurisdiction.

These draft terms cover the scoped advisory review service, which is currently offered as a free, no-obligation pilot. They are under solicitor review and are not yet in force. Each engagement remains governed by its written per-engagement agreement (see “Services engagements” above).
Each engagement covers one deliverable set — one job’s reduction report and its supporting files — returned as an annotated advisory report.
The reviewer reads your files, checks them against the agreed scope, and flags items for your attention. Advisory only — a registered surveyor confirms every finding.
The pilot review is provided free of charge. No fee is payable and no card or invoice is involved. Taking part carries no obligation, and any future paid arrangement would be agreed with you separately, in writing, before any charge.
Turnaround is confirmed by email when the scope of your review is agreed, before any work begins.
You must hold the lawful right to share every file you send for review. Your registered surveyor retains all professional judgement and sign-off over the work reviewed.
Draft wording: to the maximum extent permitted by law, liability arising from a free advisory review engagement is limited to the value of that engagement. Nothing in this section limits rights that cannot lawfully be excluded, including under the Australian Consumer Law.
Files shared for an engagement are used only to run your review and are handled as described in our Privacy Policy.
